TERMS & CONDITIONS OF SALE

Sarg's Guitars

Sarg's Guitars is a business operated by Sargon Astepho, independent sole proprietor (indépendant personne physique) established under Belgian law.

Sarg's Guitars specialises in new and pre-owned instruments, as well as consignment sales. Sarg's Guitars is a related but legally separate business from Bass Freaks and Guitar Freaks, which are brands operated by Bass Freaks SPRL. Each entity maintains its own Terms & Conditions. For new-instrument purchases through Bass Freaks or Guitar Freaks, please refer to their respective Terms & Conditions.

1 · PRICING & TAXES

1.1. All prices include European VAT for customers located within the European Union.

1.2. Customers located in the USA, Canada, Australia, Japan, Hong Kong, Switzerland, the UK, and other non-EU countries see prices exclusive of local sales tax. The customer is solely responsible for all applicable import duties, taxes, and levies in their country.

1.3. All payments are processed in euros. Sarg's Guitars is not responsible for currency conversion rates applied by Shopify, Reverb, PayPal, banks, or card issuers.

1.4. For returns or refusals from customers located outside the European Union, credit card and PayPal processing fees are non-refundable, as they are not refunded to Sarg's Guitars.

2 · WARRANTY

New Instruments

2.1. New instruments sold within the EU are covered by the statutory 2-year legal warranty.

Pre-Owned Instruments

2.2. Pre-owned instruments include a 3-month commercial warranty from the invoice date.

General Warranty Conditions

2.3. To exercise warranty rights, Sarg's Guitars must be notified in writing within the applicable warranty period from the date of purchase.

2.4. Warranty claims must be supported by photographs and/or videos. A diagnostic meeting via video call (FaceTime, WhatsApp, or equivalent) may also be arranged.

2.5. Warranty does not cover damage resulting from:

  • negligent use or improper handling;
  • drops, shocks, or exposure to excessive humidity;
  • incorrect string tension or poor storage conditions;
  • customer-performed modifications or unauthorized repairs.

2.6. The customer is not permitted to carry out repairs without prior written agreement from Sarg's Guitars. Any repairs performed without such agreement will void the warranty.

2.7. Minor fret unevenness or natural wear on vintage instruments is not considered a defect and is not covered under warranty.

2.8. Where applicable, Sarg's Guitars reserves the right to direct warranty repairs to an authorized service partner.

3 · SHIPPING & TRANSIT

3.1. All prices are stated without shipping costs unless explicitly indicated otherwise. Please inquire for a shipping quote before purchase.

3.2. If an instrument arrives damaged, the customer must notify Sarg's Guitars immediately in writing, with photographs of the item and the packaging. Where warranty applies, Sarg's Guitars will cover repair costs to restore the instrument to working order.

3.3. Delivery times are indicative and based on past experience. Sarg's Guitars is not responsible for delays caused by carriers or customs.

3.4. Sarg's Guitars is not responsible for import duties, taxes, or any issues arising during the importation process. All import-related responsibilities rest solely with the customer.

3.5. In the event of a return or refused delivery, Sarg's Guitars is not liable to reimburse import fees. It is the customer's responsibility to contact their local customs office.

3.6. Any international customer who refuses a previously ordered item will be charged the cost of two-way shipping plus a 20% restocking fee, plus any duties, customs fees, or carrier charges billed back to Sarg's Guitars.

4 · RETURNS & REFUNDS

4.1. Customers located within the European Union may return any item purchased online within 14 days of receiving it, free of charge and without providing a reason. Return shipping costs within the EU are covered by Sarg's Guitars. Refunds are issued within 14 days after the returned item is received.

4.2. As permitted by EU law, a deduction may be applied if the instrument has been handled or used beyond what is necessary to verify its nature and functioning (e.g. gig use, recording sessions, visible wear, or damage).

4.3. In-store purchases are final and not subject to withdrawal rights, in accordance with Belgian law.

4.4. For returns from outside the European Union, Sarg's Guitars reserves the right to apply a 20% restocking fee plus the cost of two-way shipping, plus non-refundable credit card and PayPal fees.

4.5. All custom orders and special orders (non-stock items) are final sales. No returns will be accepted.

5 · DEPOSITS, LAYAWAY & SPECIAL ORDERS

5.1. Deposits are non-refundable for layaway/installment plans, custom shop orders, special orders, and items not in stock ordered specifically for the customer.

5.2. For EU purchases of in-stock, non-custom items, deposits are refundable if the customer exercises their 14-day withdrawal right. Deposits on custom-made and special-order instruments are non-refundable under all circumstances.

5.3. Deposits are transferable to another instrument within our stores (Bass Freaks, Guitar Freaks, or Sarg's Guitars).

5.4. Sarg's Guitars accepts purchases by layaway (installment). Should a customer fail to meet pre-agreed payment dates or amounts, Sarg's Guitars reserves the right to withdraw from the agreement and relist the item for sale. All monies paid under an installment agreement are non-refundable; such sales are considered final.

6 · CONSIGNMENT SALES

6.1. Sarg's Guitars offers consignment sales for a commission of 20% of the sale price.

6.2. Consignment instruments are sold without VAT. Sarg's Guitars acts solely as an intermediary in a private sale and invoices the commission to the original owner of the instrument upon completion of the sale.

6.3. In accordance with EU withdrawal rules, payment to the original owner occurs 14 days after the sale is completed.

7 · PRODUCT INFORMATION

7.1. Professional photographs may differ from the actual appearance of an instrument in person. Lighting, screen settings, camera equipment, and other factors all influence how an instrument appears in images. Customers are encouraged to request additional daylight photographs or a video call viewing before purchasing.

7.2. All instruments are checked and confirmed functional before shipping. However, setup preferences (action, relief, string tension, etc.) vary from musician to musician and cannot be guaranteed. Any professional setup required after purchase is the customer's responsibility.

8 · JURISDICTION & GENERAL

8.1. These Terms & Conditions are governed by Belgian law and applicable EU consumer regulations.

8.2. In the event of any dispute or litigation, the courts of Nivelles or Wavre (Belgium) shall have sole jurisdiction.

8.3. The customer acknowledges having read and accepted these Terms & Conditions prior to completing a purchase. Placing an order constitutes acceptance.
