Sarg’s Guitars — Business operated by Sargon ASTEPHO (Independent Sole Proprietor)

Prices, VAT & Import Duties

All prices include EU VAT if the customer is located within the European Union.
Customers in the USA, Canada, UK, Switzerland, Japan, Australia, Hong Kong, and other non-EU countries see prices without VAT.
The customer is fully responsible for any import duties and taxes in their country.
All payments are made in euros. Exchange rates applied by Shopify, Reverb, PayPal or the customer’s bank are not under our responsibility.

Warranty on Used & New Items

Used items include a 3-month commercial warranty from the invoice date.
New items sold within the EU include the mandatory 2-year EU legal warranty.
To exercise warranty rights, the customer must notify Sarg’s Guitars in writing within the applicable period.

Photos, videos, or a video call (Skype / FaceTime / WhatsApp) may be required to assess the issue.

Warranty does not cover:

• misuse or negligence
• drops or shock
• humidity-related damage
• incorrect string tension
• poor storage conditions
• unauthorized repair attempts

Any repair performed without prior written approval will void the warranty.

Minor fret unevenness or natural wear on vintage instruments is not considered a defect and is not covered.

Damage During Transit

If an instrument arrives damaged, the customer must notify Sarg’s Guitars immediately in writing with photos of the item and the packaging.
When warranty applies, Sarg’s Guitars will cover repair costs to restore the instrument to working order.

Returns & Withdrawal Rights (EU Only)

Online purchases delivered within the EU may be returned within 14 days of receiving the item.
The customer is responsible for return shipping costs.

The initial shipping cost to the customer will be deducted from the refund.

Refunds are issued within 14 days after the returned item is received.

As allowed by EU law, a deduction may be applied if the instrument has been handled or used beyond what is necessary to verify its nature and functioning (e.g. gig use, recording sessions, visible wear, damage).

In-store purchases are final and not subject to withdrawal rights.

Deposits, Layaway & Special Orders

Deposits are non-refundable for:

• layaway / installment plans
• custom shop orders
• special orders
• items not in stock ordered specifically for the client

For EU purchases of in-stock items, deposits are refundable if the customer exercises their 14-day withdrawal right.

For layaway plans:

• if payment deadlines are missed, the item may be put back for sale
• all amounts already paid are non-refundable

Consignment Sales

Sarg’s Guitars can sell your instrument on commission.
Commission rate: 20%.
Consignment instruments are sold as private sales with no VAT.
Sarg’s Guitars acts strictly as an intermediary and invoices the service to the original owner.

Payment to the owner occurs after 14 days, in accordance with EU withdrawal rules.

Shipping, Delivery Times & Refusal of Parcels

Delivery times are indicative and based on past experience.
Sarg’s Guitars is not responsible for delays caused by carriers or customs.

If a customer outside the EU refuses a parcel, they will be charged:

• 2× shipping costs (outbound + return)
• a 20% restocking fee
• any duties, customs fees or carrier charges billed back to Sarg’s Guitars

For non-EU returns, the same conditions apply:
20% restocking + 2× shipping + credit-card/PayPal fees.

Credit-card and PayPal fees are non-refundable (as they are not refunded to us).

Instrument Setups & Appearance

All instruments are checked and confirmed functional before shipping.

Setup preferences (action, relief, tension, etc.) vary from musician to musician and cannot be guaranteed.

Professional photos may differ from real-life appearance due to lighting, screens, phone cameras, etc.
Customers may request additional daylight photos.

Legal Jurisdiction

Any dispute will be handled exclusively by the courts of Nivelles or Wavre (Belgium).

Belgian law and EU consumer regulations apply.

Placing an order constitutes acceptance of these Terms & Conditions.

Sarg’s Guitars - Entreprise exploitée par Sargon ASTEPHO (Indépendant Personne Physique)

Prix, TVA & Douanes

Tous les prix incluent la TVA européenne si le client est situé dans l’Union Européenne.
Les clients situés aux USA, Canada, Royaume-Uni, Suisse, Japon, Australie, Hong Kong ou tout autre pays hors UE voient les prix hors TVA.
Le client est entièrement responsable des droits et taxes d’importation dans son pays.

Les paiements se font en euros. Les taux de conversion appliqués par Shopify, Reverb, PayPal ou la banque du client ne sont pas sous notre responsabilité.

Garantie Occasion & Neuf

Les instruments d’occasion bénéficient de 3 mois de garantie commerciale.
Les instruments neufs vendus dans l’UE bénéficient de la garantie légale de 2 ans.

Toute demande de garantie doit être envoyée par écrit.
Photos, vidéos ou appel vidéo peuvent être requis.

La garantie ne couvre pas :

• mauvaise utilisation
• chute ou choc
• humidité
• tension de cordes inadaptée
• stockage inadéquat
• réparations non autorisées

Une intervention effectuée sans accord préalable annule la garantie.

Une légère usure ou inégalité des frettes sur un instrument vintage n’est pas considérée comme un défaut.

Dommages lors du Transport

Tout dommage lié au transport doit être signalé immédiatement avec photos de l’emballage et de l’instrument.
Si couvert, Sarg’s Guitars prendra en charge les réparations.

Retours & Droit de Rétractation (UE)

Le client dispose de 14 jours pour retourner un achat en ligne.
Les frais de retour sont à sa charge.

Les frais d’envoi initial seront déduits du remboursement.

Le remboursement est effectué dans les 14 jours suivant la réception du retour.

Une diminution de valeur peut être appliquée si l’instrument a été utilisé au-delà d’un simple essai (concert, session studio, usure visible).

Les achats en boutique sont définitifs.

Acomptes, Layaway & Commandes Spéciales

Les acomptes sont non remboursables pour :

• layaway / paiements échelonnés
• commandes custom
• commandes spéciales
• articles hors stock commandés sur demande

Pour un instrument en stock dans l’UE, un acompte est remboursable dans les 14 jours si le client exerce son droit de rétractation.

En cas de non-paiement dans un plan d’échelonnement, l’instrument peut être remis en vente et les montants déjà payés sont perdus.

Dépôt-Vente

Sarg’s Guitars peut vendre votre instrument pour vous.
Commission : 20 %.

Vente privée sans TVA.
Sarg’s Guitars agit comme intermédiaire et facture la prestation au propriétaire.

Le propriétaire est payé après 14 jours, conformément à la législation EU.

Expédition, Délais & Refus de Colis

Les délais de livraison sont indicatifs et hors de notre contrôle.

En cas de refus de colis (hors UE) :

• 2× frais d’expédition
• 20 % de frais de restockage
• tout frais/droit réclamé par le transporteur

Pour les retours hors UE :
20 % de restockage + 2× expédition + frais carte/PayPal.

Les frais bancaire et PayPal ne sont pas remboursés.

Réglages & Apparence

L’instrument est expédié en parfait état de fonctionnement.

Les préférences de réglages étant individuelles, elles ne peuvent pas être garanties.

Les photos professionnelles peuvent différer de la réalité (lumière, écrans…).
Photos supplémentaires sur demande.

Lieu de Juridiction

Tout litige sera traité exclusivement par les tribunaux de Wavre ou Nivelles (Belgique).

Le droit belge et les règles de protection du consommateur de l’UE s’appliquent.

Toute commande implique l’acceptation des présentes CGV.
